No response from Ombudsman's office by 45 days deadline |

I sent an inquiry to Ombudsman's office and received an acknowledgment on Feb. 21,2008 saying that formal inquiry had been initiated with USCIS and will hear within 45 days. I haven't received the response yet as the 45 days are over by this weekend.
Any one had similar experience? Is it possible that instead of replying to the query, the case might be adjudicated *soon*. Please share you experiences. Thanks

hey there i am ready to use the form 7001 for cis ombudsman did you attach any aditional documents to this form, i wrote email to different addresses but all of them were returned including the cisombudsman@dhs.gov i was like wow, so now i will wait for another service inquiry i made and if I dont hear i will send this form

I received response from them after 76 days. My acknowledgment date was Jan 17 and I received response on April 2nd.

Thanks for your reply. Did the response look like they actually look at the case in detail or just generic response "under review" etc?

I mailed(post office) them the form 7001 along with receipt notices, proof of letters sent to Congressman, Senator, and even a log of my InfoPass and phone calls.. so it was a bulky package!!

The reponse i got from then was saying" Case is under review by local office" .

very sad to hear that you havent got it yet. We both got interviewed roughly around the same time if you remember the "Transfer to National Benefit Center" thread. Unfortunately my PD never became current till date. But you have always been current and still no green card. It sends shocks through me. I dont know how long we will have to wait.

My response arrived super fast (10-14days), I was impressed to even see the new Ombudsman's signatures (yes it was not a stamp, as the ball point pen impression existed ;-)
until I opened the mail and it stated that my case is progressing normally as it is outside the normal (receipt notice date) processing window(I-485 filed June2007). It was almost like requesting me not to disturb them for the next decade!
I actually submitted via email first and attached its copy to the paper submission later - and that may be the reason for the fast response.

Hey made Onemistake sorry to hear about you too, i must wait until may 15 to see if the last inquiry i will make, can make it, the lady this time took more info about me, and said that probably they have not approved my case cause my fingerprints were not up to date, i said well i always tell in my inquiries to them about it they never apoint that, same on infopasses, and this time she wrote details how many infopasses i have made, how many inquiries, since when i have not receive the notice for fingerprints, my phone, address, email, and all that, and she said hopefully this time they will notice about your finger prints. I can see writing to big boss of the uscis doe snot help, i saw today in murthy website that wom is still possible.

I received reply dated May 14,2008 to my letter to Ombudsman's office sent on Jan. 28, 2008. I had already sent a second letter to Ombudsman's office indicating that I didn't receive response within 45 days. I received letter from new Ombudsman's office saying that they had initiated a second inquiry and additionally requested expedited handling of the matter.

Thank you for your letter date XXX, to the USCIS, Ombudsman Office concerning the status of your I-485 form. The Ombudsman's office forwarded your letter to the Customer Assistance Office(CAO) for a response. We have assigned it case # DDDDDD.
We regret the length of time it has taken to process your form I-485 application. A research of our records reflects that the processing of this case has been delayed because the required USCIS review is still in process. Until this required review is completed, we cannot move forward on the case.
Please understand that the review is part of the process in adjudicating cases of similar nature. While an exact date for completion of the review cannot be given at this time, we will make every effort to make a decision on your case as soon as the review is completed.

I don't know what under review means. My case is plain vanilla EB. This is just another way of dealing with NC pending cases. USCIS hasn't given a straight answer to these type of cases. My entry was H1. Remember I have heard it all from USCIS:"Name check","security check" and later on after the NC memo , extended review, needs additional review ..

I mailed the form to "ombudsman" on April 14 th
got reply form him first week this month, the letter was dated April 29th
on April 29th i was in Houston office on Infopass ,the IO at the window told me that , i did something really ,they are working on my file "from that day"
my status before contacting ombudsman was "pending decision by a officer", after contacting " file under review" , on last week Infopass i was told " supervisor did not make a decision yet"

I got the same response from ombudsman on March 25th "file under review" at local office.

Previous Ombudsman wasn't helpful at all for me. I was very disappointed.
All my applications were lost for about 7 months and it was the hardest thing I have ever faced. Thank god, 8 of 12 applications were found, among them the I-485's.
But all the I-131 applications (principal & 3 dependents) are still lost after almost a year now.
I have proof of delivery, a copy of the actual label with my name, uscis address and tracking number, etc.
I got transfered to different IO's, opened SR, etc
I filed form 7001 on Nov. 7, 2007 asking CIS Omb. to help me to find my missing applications (at that time it was all the applications).
I had to write several emails to get a simple acknowledge of the form received: nobody answers my request for about 3 months.
In my form 7001 I asked CIS Omb. help to urge uscis to issue my receipts, or cash my checks... whatever as long as my cases begin its process.
I completed field by field all form 7001, clearly indicating I don't have receipts, I don't know my alien # and my checks were not cashed.
I received a letter on March 27 with an official response from CIS Omb. indicating that his office can't help me because I didn't gave them information required and they ask me to send: receipt #, A# and/or copy of checks cashed.
Was that a joke? I filed the form asking for XYZ and they shoot me back requesting me to provide the same XYZ in order to help me!! And even worse, they took almost 5 months to get back to me, for nothing.
In the same letter they said that unfortunately they are unable to find ANY of my applications (and that was untrue, the fact is at the time CIS Omb. wrote the letter I already had 8 of 12 of these applications in the system since Feb/08 and they didn't realized or didn't look for them concluding the 12 applications are still missing in mid March).

I don't think CAO has any more access to cases than first level customer service. So if they feel like they push for some cases but for others simply send back an excuse!! But irony is that the wording of the letter is designed to imply that they actually "researched" your case. The "research" could be nothing more than checking the current processing dates, VB and if the NC is pending (all of which the applicant know already) and then if the status of the case is still "in process", make up an excuse, hide under the generic "review" related terms and off you go!!
In the end it's good for only going as an Appendix in WOM!
