We filed back in June of 08, we received the rfe around october and sent it in in november until now we haven't heard anything. I have called customer service, but nothing. When checking the processing dates at the uscis website it says our case is at the national service center (MSC), but they don't have the i-485 listed on there. What should I do, just wait or insist.
thanks in advanced.
here is the last update on the uscis site:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Response to request for evidence received, and case processing has resumed.
On November 13, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our NATIONAL BENEFITS CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

im on the same boat budy... filed back in april 2008, got 2 RFE, responded to last one back in december of 08 and still nothing...
|
to charlotteken:
Same here. Interview on May 8,2009 sins than nothing. Filed the case in May 2008.

to frankiejr91387:
Hello,
you can also write to the NBC and ask about your case. Has it been 60days yet since they receive the RFE.? Calling customer service is a waste of time, when you call them they read the samething thats listed on the website, which makes no sense. You can also make an infopass appt to the local USCIS office in your area and talk to someone there. Best of luck

Hallo,
we still did not receive anything other than a letter that the case is still under extended review sins the interview (after calling and ask for info). We are married two years this month and still did not hear anything after the interview. It’s sad that the only info they can give us was the letter. No other info can be provided.
|
to Kaiser:
at this point i think that they are just dragging their foot on the case, when they do this they want to see how long you guys will stay married and to make sure that the marriage is not fraud- they love to play games like that. The system is designed for us to get frustrated and give up, but dont be.
|
to kento:
Trust me we will not. We will not put our lives on hold just because of them slacking off and playing games. We will just wait and renew my EAD again. Hopefully this time they will give me a 2 year EAD.
And if they make the call and will approve my GC in the near future we hopefully get a 10 year GC and do not have to deal with them for a bit.
|
to Kaiser:
thats the spirit, getting a 10 year GC is good that means you dont have to deal with them ever again. I'm frustrated too- I was place in removal proceeding base on my first marriage. Now am fighting with USCIS in court with my second marriage. They just approve my I-130 for my current marriage which was filed in August 2008, my atty is going to court on 03/18/2010 to terminate my removal proceedings and see if i can do the AOS in court- I have been in the U.S for 8 1/2 years now. I'm still hanging on--
|
to kento:
Keep me in the loop of how your things are going. I wish you best luck on the 18th.
Hopefully we will hear something too as we are married two years this month.
|
to Kaiser:
I will definately do that...I've been married since NOV 2007- congrats on your 2 year marriage- will let you know what happen on the 18th.
|
to Kaiser:
Thank you, hopefully something good will happen- I think i have a good IJ he always waive my appearance and we really want to terminate my case
|
to Kaiser:
Hello,
Got my official I-130 approval notice in the mail yesterday-I-130 interview date 03/11/2010, received notice in mail 03/16/2010
|
to kento:
Congrats,
that was quick after the interview. Wish I had at least that.
|
to Kaiser:
Thanks, but the battle with these people is not over yet. Did you make an infopass to the local office.?
|
to kento:
I still hesitate because I need to take a day off from work for that and I am afraid not to get much more info than they gave me in the past on the phone.
If I will not hear something until the end of April I will make an appointment.
|
to Kaiser:
Good news--removal proceedings terminated by IJ
|
to kento:
Congrats. Glad you got that straight.
|
to Kaiser:
Thanks man.... I appreciate your moral support very much. Its been a struggle for me, you have no idea. I guess now i have to refile my I-485 and other docs. The struggle is not over yet ,but moving forward. I hope you hear something man... I'm praying for you, Trust me i am...My atty is requsting more money because its been a lot of hearings he went to for me, its been 4 hearings, which is alot. I'm just gonna have to dig deep into my pocket to see whats going on. Over the years i have gain so much knowledge about this whole Immigration process I feel like i actaully went to LAW SCHOOL, LOL. My I485 was denied in August 2008 and ever since i have been in court fighting for my destiny. Its was tough, but like i said still have a couple more herdles to overcome- 2 down 1 to go..

Hi...I was wondering how long ya'lls case been pending and if you received a 2nd biometrics notice? My spouse and I had our interview back in July of 2009 and to date, case is still pending. All we received was an appointment for a 2nd biometrics for his I 485 which apparently had expired.
A little backround:
I am USC filing for petition for my hubby, 4 kids, hubbys 2nd marriage (1st marriage was with a USC which lasted only weeks since the ex wife took off with another guy - no petition filed), both have clean criminal backgrounds .
I 485 / I 130 / I 765 filed oct 2008
Initial Biometrics done nov 2008
RFE received Nov 2008 (income tax)
RFE sent Dec 2008
EAD received May 2009
Interview letter received may 2009
interviewed on July 2009
2nd Biometrics notice received mar 2010 which has now been completed.
