It looks like H4 EAD does not come under the new "“Retention of EB-1, EB- 2, and EB-3 Immigrant Workers and Program Improvements Affecting High-Skilled Nonimmigrant Workers” Final Rule"
Since category c(26) is not mentioned section 3 under - "Automatic Extensions Based on a Timely Filed EAD Renewal Application"
on the page -

Essentially if your H4 EAD expires you do not get an automatic 6 month extension, even if you have a pending extension.
Is this in line with what others think?

Hi,

I am on L1A and my wife's I140 is in process to file. Does anybody know how to file L1-H4 COS with EAD. It would be real help if someone can provide the detailed steps.

Note: I am assuming that I can file COS and EAD on my own and do not require attorney for it.

Hi

I am filing for H4 EAD for my wife. When we entered USA, I-94 is stamped till Jun'17. After that I apply for an extension, H1 and H4 got extended till Jun'20.
As part of that extension I have received a copy of I797, which at the bottom has I-94.

So should i be sending this I-94 which is the bottom copy of latest I-797 that shows till Jun'20
or should i download from the government website https://i94.cbp.dhs.gov , but this only shows till Jun'17
or should i send both

Any help is greatly appreciated.

As per my knowledge, you will need to send the latest copy of I-94 from I-797A. The initial I-94 issued at the port of entry becomes invalid after you have received the new I-94 with I-797A.

I need one clarification:

I have approved I140 with company A with recently approved extension till 2020. My wife also got H4 extension as well EAD.
I got offer from company B, so my question is if I move to company B, company B will start Labor application .
What happens to H4 EAD, can my wife work when moved to B meanwhile , or she has to wait till company B completes new Labor and I140 process.

Looks like there is something wrong with your filing. Did you file with the correct fee of $410 ? How about the I-765 edition ? I once filed with the wrong fee that USCIS took a month to reject it and return it back to me with a notice. However, in most cases the receipt notice arrives within 5 days if the filing is proper.

Your wife is good to work until 2020. Are you sure your I-140 was approved earlier than 6 months or are you certain your employer won't withdraw your I-140 ? Your employer have a chance to withdraw it that will eventually allow USCIS to send your wife a NOID(Notice of intent to deny) on her EAD. Should you have no other approved I-140 by that time , her H4 EAD is as bad as revoked.

My I140 was approved in Jan 2016 but later amendment was filed which was approved in Sept. so, it will be more than 6 months since amendment is approved.
can you please clarify:
1. based on new rule, if I140 is approved more than 180 days, I140 will not be revoked by employer, is it true.

Well, That's what the rule says and I can't guarantee as there could be false positives. Since you got 3 years I can imagine the time your wife needs her EAD renewed, you would have your new I-140 approved. I would go with the offer for a reasonable hike since the Eb2/3 wait times are over 10 years now.

I applied for the H4 EAD. Since the H1b I-129 started in WAC, I have sent it by Fedex to the Phoenix address. It reached on 7th March. I have not yet received any email regarding receipt. How much time does that take?

Check deducted from bank: 03/08/2017
Receipt# Received: 03/10/2017 mentioning case has been accepted and routed to the USCIS California Service Center for processing

Thanks for posting details. I have question. Regarding the validity period of H4-EAD (I assume it is 3 years from the date of issue) does it count from the date of it is approved which in your case is 2-2-2017 or was it given wiht a validity date of your H1B and H4?.

Can anyone tell how long it is taking to receive H4 EAD ? From the tracker I can see anywhere from 23 days to 92 days.. Also is there a 90 day deadline for USCIS to make a decision? Please let me know..

PS: I ll be applying from California..

I have I-140 approved. I have applied for H1, H4 extension for me and wife. My wife's EAD expires in August and looking at the current processing times, I don't think I would get the H1 extension approved before October.

Can I file my wife's EAD renewal along with the H1/H4 extension receipt notice?
If yes, would USCIS renew the EAD before August or wait till my H1 extension gets approved?
If USCIS renews the EAD without waiting for H1 extension, what would the new EAD period be - 6months or 3 years?

Hi,

My H4 EAD expires on the 7th Oct 2017 and my husband's H1-B expires on the same date. We are in the middle of initiating the extension process, very likely to apply in premium processing within 15 days by the company. What will happen to my EAD if the H1-B does not get approved within OCt 2017 ? Do i have to quit my job after October or can i continue with the filled petition ?

Hello

Can anyone advise on my dilemma. My wife is on H4 EAD, she just got a job and thinking about getting H1B. Our visa is expiring this August 2017. Is H4EAD going to stay. I hear so many rumors about removing EAD for H4s.

Can anyone advise if we should apply H1B and not worry about H4EAD.

I know it completely depends on individual's opinion but would like to know.

Have a query on H4 EAD validity when travelling India for vacation.
Currently have H4 EAD valid until 2019. As a H4 holder if we travel to India for vacation for 4 weeks alone without H1B holder will there be any impact while getting stamping in India , whether any impact to existing H4 EAD validity , incase officer while stamping provides more or less date mentioned in I-94 Date? whether H4 EAD validity expires if we travel to India for vacation and require reapply of H4 EAD again? Appreciate your response

You should be good to get your H4 stamping even without your H1B accompanying you. There is nothing that changes your EAD on account of traveling outside the country.. EAD remains valid until the expiration date and has no bearing on your travel.
