My company's law firm just contacted me saying that they are auditing my case AGAIN! This time they have to get back to DoL with info about the recruitment efforts.
I guess in a way this is some sort of an update instead of the usual silence that has stretched on for over 6 months. Hopefully it's an indication that they're beginning to sort through their pending audit cases now.

Law firm responded to the 2nd Audit request on 6/10/2008. Keeping my fingers crossed!

Hi Kross: I am in the same boat and my company is also a big employer nationwide. While I also got a 2nd audit, my lawyer told me that because of the Fragomen issue, 100% of the new applications are being audited and all of those who were already in audit phase were issued a 2nd audit!!! So, actually, it is possible that the 2nd audit was an automated response without any actual progress in our cases... I only hope I am mistaken but...

*sigh* still waiting... Case is STILL pending.

In a week it'll be 600 days! :(

I hear they're currently working on September 2007 cases so that gives me hope, but as the days go by and I hear nothing, I'm beginning to realize that the best thing to do is just not even think about it and hope for the best.

Here's to hoping I don't hit the TWO YEAR (without any sort of a response) mark *fingers crossed*

Kross,

Dude we're left behind now. More pains and wait to come like some of pending may /june / july / aug 2007 pending cases which haven't got any status until now.

Apparently, the mf's have been processing OCT cases and looks like they might not touch the leftover sept 2007cases like they did for pending cases for eariler months. Your country has a current PD so why don't you file for it again but it depends on how many years you have left on your H1B.

Well my company just renewed my H1B for the first time this year, so that goes until 2011 and then I have one more renewal after that right?

I have been in touch with my lawyers at Fragoman and they have thus far told me to hang tight... but the frustration is slowly getting to me and I don't know how long I will be able to just wait before I just want to pull the plug and start anew. I think the 2-year mark (which for me will be 9/09) will by my point where I'm done with this. TWO YEARS for a freaking LABOR CERTIFICATION without a SINGLE status update?!?!?!?!? RIDICULOUS!!!

FINALLY!!! Approved on July 1st, 2009.

Now I can sit back and REALLY enjoy my 4th of July weekend :)
