why EB3?you have MS degree, you can go for EB2

I think MS=2 years and 2.5 years Exp of Quality that makes it 4.5, less than 5 for EB3? I guess...

Thanks for your concern goldie1.

Quality Engineer position does not really need an M.S. It is not a 'Senior' QE position. My 6th year of H1 ends in May of this year. Almost all EB2 PERM's were getting audited last year. My lawyer said this was the best bet to get PERM approved within my timeframe.

as far as i know,if u have MS degree you dont need to show 5 yrs to get qualified for EB2.All MS degrees fall in EB2

not necessarily.. it all depends on what YOUR job requires.. you might have a MBA and 5 years of exp BUT if your job requires a bachelors and 3 - you will be in the EB3 category..
Just a MS / MBA does not guarantee you anything..

Thats the reason, the lawyer you have is o freakking imp in this entire process..in consultation with your mgr, they decide where you fall.:)

Exactly. It is the JOB req that counts, not the kind of degree that you hold that dictates whether you file under EB2 or EB3. This is especially true with the PERM process.
