Yes mine is still pending.

However seeing other people who filed around the same time as us (For example sexyanita who get certified on 7/7), I think ours should also be round the corner, maybe next week.

Hi mvniays, It is my observation that you have been consistant in replying to questions asked in this forum. I too have 1 for u. Has ur labor been certified as of today ?? The last case certified in this forum was April 20, 2006. After that either cases have not been certified or people have failed to update. My priority date is 5/5/06. I have no source to check my status online as my employer asked me to contact the lawyer to create a sub account & my lawyer refuses to do so. So I am relying right now on the experiences in this forum by other people & making approximations as to when my case wd be certified. Thanx in advance

Update on PERM
At the American Immigration Lawyers Association conference in San Antonio last week, top Department of Labor ("DOL") officials provided updates on the current state of the PERM labor certification process. The DOL is confident that, while it is still working on overcoming some issues with the system, the process is improving and providing a higher level of service and quicker processing times than the pre-PERM system. At the time of the conference, DOL officials indicated that the PERM processing center in Chicago has adjudicated 91% of its pending cases (52,000) cases with only 9% currently in the pipeline; and the Atlanta processing center has adjudicated 87% (56,000) cases. The Atlanta processing center has experienced some recent transitions and staff changes which has affected the processing of cases filed with this center. However, DOL expects that processing times will decrease with the recent addition of a new Certifying Officer, who successfully headed up the regional Atlanta DOL office prior to the implementation of PERM.

Following the one year anniversary of the new PERM program, at a recent meeting the Department of Labor provided some updates on pending PERM cases since its implementation in March 2005.

Number of Cases Filed 80,272
Number of Cases Certified 36,687
Number of Cases Withdrawn 1,950
Number of Cases Denied 23,205
Number of Audits 24,969

From these figures, it appears that the success rate of a PERM application has been approximately 45%, which is not a comforting thought to many of you who have or are preparing to file PERM cases. Keep in mind that the initial launch of PERM in March 2005 was met with many system glitches that have since been resolved. Although we have seen some improvement in the PERM

Hi,

Some people who filed much later than us have received approvals. Wonder why our cases are still pending?

I am trying to guess what could be common about the pending cases. Size of company? 1st time perm case? Maybe we all filed under a different category (Eb3 -- different company) earlier under non-perm and then also filed under EB2 (new job)? Same attorney??

Any ideas as to how we can check and find out what's going on?

My case is still "In Process" as of a few minutes ago. There is no rhyme or reason in the order in which DOL processes PERM applications. We have no choice but to hang in there and wait until they process our cases. I read murthy forum and immigration-law.com that Atlanta PERM Center recently had some leadership changes and also some internal procedural changes which is causing delay for cases that have been filed recently (last 3 months or so). Please keep me posted about your approval. Thanks!

I wrote to my lawyer asking them if they knew why my case is not being approved whereas many filed much later than mine are being approved. They wrote back saying they have contacted Atlanta DOL to find out. Hope something will come out of this.

This is the response that I got back from the atlanta center:

Thank you for your e-mail to the National Processing Center concerning your case filed under the PERM program.
Case:xxxxxxx is still in process and official notification will be forthcoming.
Applications are processed in the order they are received. However, because each application is unique, processing times may vary depending on the specific circumstances of the case.
We apologize for the delay.
If the case was mailed in, then the employer and representative must await correspondence from this office. If the case was filed online, status of the case may be checked online, by following the directions below.
To check the status of your case filed online: go to the My Applications tab, then the Search Cases tab, you can enter your case number and see the current status. You can also search by a partial number. For more details, see Page 40 of the User Guide by clicking the Online Help link at the top of the PERM web page.

Did you send an e-mail by yourself to PLC.Atlanta at dol dot gov? If not, which e-mail address did you send it to? Is it okay for the alien benefiaciary to enquire about case status via e-mail instead of the employer or attorney? Please let me know Thanks!!!

My lawyer send the email to [email protected]. I suppose that you can also send the email yourself instead of your lawyer/employer.

I found out through online status check. No e-mail was received. The only way to know is by checking status online.

i do not know exact date when labor was approved. My HR gave me the good news that labor has been certified. so I have put a tentative date. Gc posthumously is also close to certification. best wishes to every1. God Bless.

As we submitted on the same day, I wondered when you get certified.
It was a long time for us, but anyway certified!!

I already received the paper document and currently preparing for the next steps.
