Hello GCWaiting2007, could you kindly let me know what the "Business Necessity" is all about? I myself received an audit for the same. Is it a highly unlikely reason or a common reason for an audit? Do you know any cases that were certified after receiving an audit for "Business Necessity"? Do you have a sample of the letter that was submitted that you could possibly share with me?

I had also received business necessity audit. My attorney said it is the most common audit they art e receiving lately. basically it is the question , " Prove that it is necessary to have some one with this skills and not less than that "

it seems that DOL is approving the cases older than 400 days...hope you will get approval in month or so...best of luck
