God!! If your PERM is not being approved within days (or let's say, hours), you will not be able to file AOS for years. Not just 2 or 3 years. Especially you are from a retrogressed country. July visa bulletin is an once-in-a-life-time event. How can you miss it?

Thank you all so much for your support and well wishes... I'm still shaky and in shock. Went to lawyer who agreed to file (he'd previously said it was too late). I do trust he knows what he is doing and will file it even without the actual hard copy if it doesn't come by Thurs. I know I sent an email inquiry to atlanta on thurs sort of acting like employer but without stating my name as employer etc (so didn't lie). i'd used my own email addy, so it was clear who emailed. yesteday got standard email from atlanta that inquiries can only be made by employer/contact on PERM. So they do check. Today I have approval. I think more it's God that helped. I was supposed to be taking a flight out tonight, bought tkts too..one hr before departure from home I find out. I don't think I can sleep tonight : ) I do have you all in my prayers still.

am in process..signed off all forms yesterday at lawyers, got employment letters today...now going back to lawyer to hand in. I don't think the hard copy will get there in time though, so nervous. I will get RFE for medical cause lawyer wants to send out package tomorrow and my doc appt is today, with TB test, results won't be in until Fri...

dsikka did you get hard copy? Did you file...

cool man, i did the same yesterday. running back n forth from the lawyer to the boss, getting signed n stuff. NO hard copy but sent them 13 page DOL print our of form 9089 (at the bottom it says validity dates of the certificate) + screen shot of "certified". no medical, will do RFE. also my lawyer said, "if you 485 is not approved in 12 months, which it looks like given the backlog they have and the retrogression they will go back into in Oct, you would have had to do the medical again, so dont worry."

did 140 online yesterday, my lawyer wanted to wait for hrad copy in mail till today. dint come till 20 mins ago, so she sealed the packet (1. 140 & supporting dox ; 2. 485/131/765 n dox) to be dispatched for overnight, to be delivered tmrw. Again, just included 13 page 9089 print out of form 9089, got that signed by boss, screen shot of ETA page saying 'certified' instead of hard copy.

Thanks dsikka. I have some questions.
Today again at lawyers, I got a copy of ETA9089 with some OBM approval number on top...this is not original Hard copy approval. They gave it to me to get it signed by HR, just in case. Tomorrow they will wait for mail, see if hard copy is there, then I have to run somehow get that signed by HR before the woman leaves (hardly any time in between, so don't know). So I guess if hard copy is miraculously received, then I have to get that signed by HR. If not, then I will have a copy of the ETA9089 with that weird OBM approval number and some validity till march 08 on top of form (not sure what this is). Lawyer's office didn't ask for screen shot of LC, but I will try to push employer to give that to me tomorrow and take that in to lawyer's office too...it's just a screen shot and HR signs it?????

As for how it's being filed. I don't know much about things but trust my lawyer as he seems confident and well aware of things. I don't know if he is filing I140 online then sending I 485. I have feeling there are 2 packets but maybe filing both through mail cause they keep talking about "sending it off" and no talks on efile. I wonder what's better etc.

Medical started getting that done. Will have report on Fri...bit late...but I will leave it with lawyers as I'm leaving country on Sunday (i asked my lawyer 10x if that was ok and since i have valid H1 visa stamp, says i'm fine).

I am SO SO tired of running around like a headless chicken right now... more running tomorrow at least.

I think at my lawyer's office they think of me as a "miracle last minute approval" ;)

ps , thats exactly what i did all day yesterday, running arnd. my lawyer also said we will wait for hard copy till today, it dint come by 330 pm so she sent the ups.

my boss signed on the 9089 form print out, it was 13 pages, last 3 pages were print outs of my job desc. ideally, as we have seen in the forums since last 4 weeks, uscis requires the hard copy, but, given that we only hv 2 days to get this packet to them, i got my boss to sign on 9089 print out with obm approval #, at at the bottom of each oage is the validity, i think mine was till mar 08 also; dont worry. i think that when till when this Lc can be used to file 140, afte that it becomes in valid.

reg screen shot, i just took one as soon as i saw 'certified', my lawyer said its not needed, but i insisted on her that this extra page be incuded with the 13 page 9089 print out. it din matter to her, she said, if it makes u happy i will.

no HR sign on screen shot needed. BTW, ask the same person in your HR to sign the 9089, whose name appears on the print out.

sure, i trust my lawyer too, but , all anyone who messes up, if,they do, can say is sorry. please double check, double check, doubcle check eveything. find rakib's ID in our forum and in his posts he posted a checklist, that pretty good.

dont worry abt medical, do it , dont do it, dsnt matter. go home man.

my lawyer, 'she', used "you are fucking kidding me" when i told her. she was like , i dont hv time , come over n do it yourself, i was in her office all day Tue. leme know if u need anythn. i will check this page tmrw mrng again, if u needed any thing. good luck.

I'm trustful of my lawyer because Ive been with them from start of my H1B and they never messed up anything, took care of all. Also they never tried to 'take me for a ride" moneywise. It's all set fees and I've asked them questions, gone in for consults, etc, never have they asked me additional. They are a big law firm, very very busy. I saw the stack of files they have yesterday to send out...so I do trust they know what they are doing. But still I keep asking questions lol. I will ask/check again today. I will get ETA copy signed and screen shot and have that for lawyer today. I just don't know if they are efiling the I140 and am nervous about this whole thing...

and so so so achy... today is another hectic day...tomorrow should be better...sunday i sleep on the plane.

So now it rests in God's hands. Got copy of ETA signed by HR. Got screen shot of LC. Lawyer's office to send out it all today (they claim i'm their first that they are sending without LC hard copy...so that makes me nervous). They are doing I 140/485 by mail..no efiling for I140....i'm hoping they have good reasons for that. I will get medical finished tomorrow, hand in report to lawyer's office (i know it's late but since I'm traveling on Sunday, I want to leave it with them in case behind me it's asked for). So that's all...now I'm so scared that without LC original hard copy and medical (though this i know is acceptable) something will go wrong. Worried something missing etc...but if God brought me this far...God will have to help me keep going then and it's all in God's hands.
