after waiting for 3 months USCIS issued RFE, currently working on responding to RFE.

Similar thing happened one of my other colleague.. It looks like USCIS is short on staff and are issuing RFEs to buy more time... :(( Unfortunately for me they picked my case...

Hi.

After you replied to RFE. what is the status in USCIS website?

We replied to RFE and it just shows the status as -
On June 12, 2015, we received your response to our Request for Evidence for your Form I-129, Petition for a Nonimmigrant Worker, Our Vermont Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you.

Does it get another status before the decision or it will remain the same. Could you please share your case status flow. Thank you.

Status of RFE response is similar to normal case processing..

If RFE response is submitted in regular mode, status will change to "Initial Review" stage and stay there for 60-90 days until decision is made on your case..

If RFE response is submitted in premium mode, status changes to "Acceptance" stage and then directly goes to Approved or Post Decision activity stage.
Typically within 7-10 days or earlier than that in some cases..


I had to submit RFE response in premium mode due to personal reasons and got approval in 7 days. if you are not in a hurry, then I would suggest submit the response in regular mode. and if there is need only then upgrade to premium on a later date..

Hi,

Once you upgrade to premium, does the status in the online reflects that you have upgraded to premium processing or stays as is until decision is made. Reason I am asking this is, my company says they filed for premium. But I am not sure how to validate if it is actually upgraded to premium.

Yes. Once USCIS receives your request for premium processing, status shows that case bas neem upgraded to premium. something similar to below:

"We received your request for premium-processing of your Form I-129, Petition for a Nonimmigrant Worker, and mailed you a receipt notice."

As far as I know, USCIS has temporarily suspended premium processing until July 27. This was done on May 26th, 2015.
