Today, EIG started receiving returned premium processing checks from USCIS for H-1B visa extensions (and upgrades) filed between 3/20/17 and 3/30/17. In the boilerplate notice from the USCIS, the Service notes that the fee is being refunded due to the fact that the agency cannot adjudicate the case within 15 calendar days. However, the Service states, “please be assured you will receive premium processing service and your petition will be processed as soon as possible.” EIG believes that the USCIS has made this procedural decision after having received an overwhelmingly large volume of premium processing petitions and requests before the 4/3/17 premium processing suspension went into effect.
What does this mean for my case? Per USCIS, your petition will still be processed by the premium processing team and will receive premium processing service, but the agency (by conducting refunds) will not be legally bound by the 15 day adjudication timeline. While your case will not be adjudicated within 15 days of EIG’s submission, we do anticipate a shorter adjudication time – far shorter than regular processing service.
