@vadas123 - Did you get 2 different RFE's? i saw another post from you with different RFE details, i am trying to understand if we will accrue unlawful presence if the RFE gets denied after the grace period.
My RFE has all sorts of things, org structure, employer-employee relationship (although it is a non consulting firm), workload for the period in H1b etc, this is supposed to be a simple transfer, but i guess nothing is simple with the current uscis!
I got two offers and both the companies applied for H1B, one is EC model and the other FTE, I got maintenance of status for EC model and surprisingly employee-employer relationship, specialty occupation for full time position.
Did you already join? your grace period ends soon I would imagine? which model did you happen to join, and also have you done any research on what happens if the visa gets denied after the grace period?
@rak12345, I joined in FTE last week, attorney is confident that this case will be approved, worst case, they are going to let me work as contractor ( provided the H1B with Desi Employer gets approved),if not, they are going to file another h1b with same LCA in regular processing.
I joined FT with receipt notice, that is why i am wondering what would happen in the off case that the H1B gets denied, we will have passed the grace period and do not know how the transfer would work at that point.
