My case still in "Initial Review". Any progress from you people ? :(

Still my case is in "Initial Review". As USCIS they are processing app till March 31. Don't know how long it’s going to take. Any updates from you folks?

Did you received any update or is ur visa approved? Even mine is pending for the same from last 4 months

No. Same status here. No update and case is still in pending without RFE

Key Krishnan, Did you got any update for your VISA.... I dont know whats going on with our processing. Mine is still under initial review.

No. Same status here ("Initial Review"). We are planning to calll USCIS on monday and open service request since my application was pending more than 180 days. Hope some thing will come up. Did you any LUD on your app?

No mine LUD is still 06-Apr-2010 and status as "Initial Review". Got fed-up seeing that Blue circle.

Did you got any update on ur visa after you created service request

No still same. My Law firm call VSC on 08/23 and they gave Order confirmation number. After than no update . It’s really frustrating.
BTW, I checked USCIS web-site (processing time) its showing for New/Transfer dates are April 10 2010.

Hi,

No man.. USCIS sent email to my employer as "The processing of your petition or application has been delayed. We are awaiting further information from another office to assist us in the final adjudication of this case. As soon as this information is received, processing will continue on this case". I believe my application got stuck some where (BG check .. etc).

Not planning to upgrade to PP. will wait for a couple for weeks more :(.

Do you know how long we can work while our case is pending? I am waiting for approval since april 2010. RFE Responded on Sept 8th but no updates yet. my previous h1b got expired on april 30th.

I dont now if I have to convert to Premium processing.

Just saw Soft LUD "10/03/2010" this morning on my case. Looks like something going on !!! Hope for the best.

Strange.. It happened to me also on 10/03/2010. may be uscis updated something on our cases which are pending since long.

Last week I asked my attorney to upgrade my case to Premium. Till now my case status shows as "Initial Review". Ideally it should be changed to "Acceptance" then back to "Initial Review" or At least LUD should get updated from 10/03/2010.

Sorry Cvira, I just spoke to my attorney, it seems they haven't sent my document to USCIS. Since I am upgrading my case to Premium and raising Amendment to include my I-140 approval to get extension for 2 years.

Sorry for the confusion dude.

My case is little complicated. My H1b 6 Year (after all RECAPS) expires sometime in Nov/Dec 2010.
My Transfer with Company XYZ is currently pending and got my I-140 approved for Company XYZ. I asked my attorney what are my options if my transfer petition is pending for beyond Nov 2010 and it seems following are my options.

Option 1: Upgrade my H1 transfer petition to Premium and wait for the result. Base on the result we can fill Extension.

However if my H1 transfer petition is in any kind of security review or name check , then USCIS will not accept to convert the petition to Premium (and the premium money will be returned). In that scenario I have to fill Extension by end of Nov 2010 on top of my pending transfer petition. The reason for me to suspect my petition would have stuck with Review because of this unusual delay and also when we raise the SR, my employer got email from USCIS as “The processing of your petition or application has been delayed. We are awaiting further information from another office to assist us in the final adjudication of this case. As soon as this information is received, processing will continue on this case.”
To avoid this rework, we opted for (Option 2).

Option 2: Upgrade my H1 transfer petition to Premium and raise Amendment to include Approved I-140 and asked further extension.

Possible by this week or next week they will send this document to USCIS.

I am in deep mess !!! but what to do .. Let’s see what happens!!

I believe if you have applied for transfer your company XYZ would have asked for 3 years of transfer + extension because you had only 6-7 months left at time of your transfer.

So based on your transfer, You might get transfer approval of atleast 1 year (if not 3 years).

I got an RFE on Nov-15, but Laywer did'nt recd any details yet. Waiting for some update from laywer.

Got Soft LUD on 12/08/2010 and 12/09/2010.
