Approved without I 94 I think I was out of status when my h1b transfer petition was filed. As you can see from dates below there is a gap of nearly 45 days between my last pay stub and time when petition was filed.

Hi Shaunak,

I am sorry to hear about your RFE. Unfortunately I am also in the same boat. I do not have pay stubs for month of January, but my termination was sent to USCIS on last week of February (I dont think the termination letter matters if you do not have pay stubs). If you can please update me how you are dealing with this RFE, that would help me immensely. I did not dare to premium my application. Filing date : 02/10/2012.

Thanks,

Sree
