Hi Raj2008,

I've seen you actively tracking the status of all the applicants for Oct 08. Thanks for doing that.

I've got few questions -

1) what's the advantage of filing the parallel application of I-140 and I-485?
2) what has been a general approval timeline for I-485?
3) after having filed I-140 in Oct 08 which is still not approved, can I file my I485 now (since I did not file both the application in parallel?)

The reason for above questions -
1) when I asked my company immigration manager to file parallel I-140/I485, they said it was too risky.
2) They also suggested that if my I140 gets rejected, I will waste money on I485 application...
3) After analyzing the situation, I feel they've pushed me to not file for parallel processing because of some internal reasons!!

Please share your thoughts and comments.

Therain here are the answers to your questions:

1) what's the advantage of filing the parallel application of I-140 and I-485?
(MOSAX) The only advantage is that you can file for an EAD and AP based on pending I485
2) what has been a general approval timeline for I-485?
(MOSAX) the recent trend is showing that AOS is approved in about 30-45 days of your I485 approved
3) after having filed I-140 in Oct 08 which is still not approved, can I file my I485 now (since I did not file both the application in parallel?)
(MOSAX) Yes you can file your I485

(MOSAX) a friend of mine too had the same problem. however its just a choice the lawyers make whether to file them concurrently or separately depending on how strong your I140 application is.

I sincerely hope u get ur I485 approval before u leave ... however have u thought of invoking Ac21 ..Since ur I140 is already approved and its 6 months since u filed for I485.. u can change employers by invoking AC21 portability ...

I am in the same boat as u .. my employer has asked me to move back to india .. i have a few more weeks .. my I140 just approved and am trying to get as much information on AC21 portability .. let me know if u have any info on this ..
