We opened a service request lasy=t august and then again this feb.
Everytime we recive answer from USCIS asking to wait for another 6 months before we can contact them.
When toinfopass appointment,officer said that case is under review and they dont have anymore details.
God knows whats going on with our applictaion.
Is there a way we can speed up the process.
Our proprity date is current but got stuck with 140.

I believe congressmen's office is really efficient..At least in my case. Do a google search or even a search in trackitt forum and there was a post with all the congressman and senators office in all states.
The beauty of it is that you can just email them..and follow it with a phone..I did not even called them.
The first response after my inquiry was within 3 days. The same week, I got a snail mail from them asking permission to do an inquiry on our behalf and additional information related to the case. Once I send them..there was a follow-up email stating that they received my mail. 2 weeks. No response. and last Tuesday, I got an email stating that my case was approved last Monday.
I did multiple things from my end. TSC streamline..Calling USCIS...and the congressmen..
One of the things finally worked..
But I had a very nice experience with the congressman's office..

My previous emplyer said my 140 is approved but he is not very cooperative and i dont even know my 140 case number.
is there a way to know if my previous 140 is approved or not.
Infopas they said they cannot give info as this is employers .

It's so pity that the position we are in. Couple of guys are getting cleared in days. What did we do wrong?
When they process it? They should have processed first come first serve basis. They don't have control in processing applications.

My 140 is still pending.
No LUDS whatsoever.
SR has no impact.
Wrote to congressmen couple of weeks back.
Nothing changed.

We opened SR once i aug 2008 and again in feb 2009.
Both times we got reply asking us to wait for 6 months before we contact USCIS again.

I dont see ur case profile.
When did file your case and can you provise details.

I do not know if we can contact AILA directly. If you are paying
the lawyer convince him somehow to contact AILA. Hope you will
get some result from the congressmen.

140Pending, you should not have to wait 6 months btwn SRs -- I was told by USCIS 60 days. (My employer's lawyers were the ones who opened the requests.)

I finally did ask my Senator (virginia) for assistance after the 2nd SR -- I only had to provide details of my situation and privacy permission in writing (faxed a letter with details per instructions on his web site). A week later, disappointing snail mail from the Senator's office with the same update I'd been getting (my case is with an officer, no estimated time etc). However, another week later, I received email update from USCIS stating my case was approved.

Regarding your case details, your previous employer's lawyer should provide this, or at a minimum the case receipt #. If your current lawyer can't get this, you might try USCIS customer service.

My lawyer is very laid back and just keeps saying to ait for 6 months before we can open another SR.
He will not open any Sr.

My previous employer will nort give any information obn my approved 140 and as said my company lawyer is of no hope in this matter or even contcating AILA.
Employer is not ready to accept changning lawyer even if am rwady to bear expenses.
Sent letters to senator but so far no reply from its been almost a month.
I tried everything i couls and all i can do is now JUSt WAIT hopefully not for ever.

Sorry to hear. I should've mentioned it only helps when the senator/rep is pro-immigration (mine is married to an immigrant). Perhaps you've already considered retaining your own lawyer anyways? (not via employer) He/she would be paid to act/advise on your best interest, rather than the employer's. At any rate, I know this is immensely frustrating... best wishes for progress.

Contcated congressmen and below is the reply fro USCIS we had.
Since the I-140 is using the skilled worker classification, (3rd preference), as of 4/8/09 the State Department issued that there were no THIRD PREFENCE visas available at that time. The individual's I-485's, would fall under that classification and would be placed on hold till a current visa become available."

Unbelievable that they are processing based on priority dates ,

I am sailing in the same boat as you are, 140pending. Congressman told that my I-140 application was sent to I485 officer and I485 officer will process it when visa numbers available. Rediculous. Why they want to tie up I-140 with I485. They can as well process it separately, so that we can change the employer easily if I-140 get approved. In my case I have already changed employer because he went out of business. I-140 is still pending. What a pain!!! I don't know when the visa numbers are available for EB3.

RFE is still not yet received as per Attorney and Employer.
Called USCIS today to resend the same and requested to extend the time period to reply RFE as we haven't received yet.
The rep said she will request the same but is not sure if that will be accepted or not.
Waitinng for the RFE mail.
Attorney's office are of no use in my case as they are not even doing a followup .
They submitted for premium processing and it came back stating they used wrong forms/outdated forms and meanwhile we had RFE on regular processing.

I got approval e-mail from Congressman office today saying that my I-140 is approved on September 3rd, 2009. I am waiting for approval notice. Goodluck. Hopefully you also hear the good news soon.
