Hi Chris

How many days it took to receive the Approval Notice from TSC after your 140 approval update on web site? Mine was approved on Jan 22, still I have not received the approval notice

How do you know your priority date was successfully ported. I am in process of filing I140 for porting.

I-140 approval has the old category and date, thats how i got to know.

I am doing the same currently ... how much more time to get the 485 approved do you think ? Or it is just wait and watch game again ?

its wait and watch until i have my wife's 485 applied and if that doesn't trigger any activity, will probably call USCIS.

Chris - Can you clarify if this is what you did to transfer your priority date - file for your I-140 for the EB2 Perm and attach the copy of the earlier approved Eb3 I-140 with it requesting for the transfer of priority date....as a result you got your EB2 I-1140 with the earlier EB3 priority date? Plz confirm. Tks.

Hi Chris79,

I am doing porting from EB3 to EB2. My labor is approved (EB2) and I 140 EB2 (premium) is filed today.

My lawyer says that there is no need to file new I 485. She mentions that it once I 140 is approved , she will send letter to USCIS to port from EB3 to EB2. She also references ALLA (American Lawyers Association) and tells me that it is how it was suppose to be done.

My question is - is that right thing ? Don't we have to file a new I 485 ?

Please provide your feedback.

You don't have to apply a new I-485. Request your lawyer to send a letter referencing the existing 485 and porting will be automatically taken care of.
