Hello Finanalst,
I am going to be in same boat as you. My PD is Sep-03-2011 India EB2 which is not current. My lawyer is planning to file I-140 concurrently. I see you have same case as mine.

My confusion is, Is it possible to file I-140 concurrently while PD is not current? My lawyer has selected I-485, I-765 & I-131 on Part-4 Que 4 of I-140 form. Was it the same in your case too? if you can provide the feedback that would be great help.

As per my understanding, I-485, I-765 & I-131 can be filed only when dates are current. My application was filed as am not chargeable to India. Your attorney would know best.
