Hi, I am in the similar situation now. I did not get the experience letter in the required format from Infosys (my ex employer) and I have submitted notarized affidavits obtained from Infy colleagues while submitting my I-140 in premium. Now, I have received an RFE saying that I need to submit experience letters from employers on letterhead. I am just consufed! Can you explain your case a little more like did you apply the affidavits in the original I-140 filing and got an RFE? etc? Please help me. Thanks in advance.

Hi Malleswar, I did submit the affidavit with my initial I140 application. When I received the RFE, I submitted proof (emp verification letter) that the person (who signed affidavit) was employed during the same period. I also submitted another affidavit from another ex-colleague and proof (W2s, payslips, offer letter) that he was employed in the same period. Hope this helps

Hi, Thank you for responding immediately. Can you let me know how did you get the employment verification letter for the person who signed the affidavit. Also, now lawyer wants me to get the experience letters from infy and other employers at any cost and I am skeptical that infy will provide. Not sure how to convence the lawyer. Can you let me know the the inputs you got from your lawyer at the time of responding to your RFE. Thanks much!

@ Malleswar: I requested my ex-colleague and he logged a request in internal request center for the emp verification letter (with dates and his role). There is no way to get the detailled exp letter from Infosys. Whatever I did was suggested by my lawyer, so what I did is what he said.

My manager gave me his employment verification letter (he is still with Infosys). When I spoke to attorney, the other alternative is to submit your excolleague or managers pay stubs and/or w2s (all the amounts can be striked out). hope this helps.

To pritiusa,
For my RFE, I took print outs of the emails from HR (which states that they will not be giving the exp letter). Also, submitted proof (it could be payslips, w2's with amounts striked or emp verification letter, offer letter etc) that shows the person who signed the affidavit is employed with the company.

Just to be on the safe side, I also submitted another affidavit from another colleague along with his proofs.
Hope this helps.

Thanks nkbobby. Should I submit the person who signed the affidavit's salary slips or mine. I have my payslips, form 16,offer letter, releieving letter.

How can I get my manager's details. He was the one who signed my affidavit earlier. wat are the details i need to ask from my manager.

To pritiusa,
- You need to submit docs that prove the Manager who signed the affidavit is employed with the company. Docs may include his relieving letter (if he is no longer with the company), his pay slips, his w2s or employment verification letter (if currently employed)
- You can submit your payslips and W2 as extra proofs

Explain your RFE in detail to your manager
