At least it's in review. Mine is still in acceptance. I think you get your approval end of this month or by November for sure. This is the good thing bout NSC is that they keep their timeframe promise for the most part.. If your case is straightforward and all paper works are complete then you should be good. Maybe next week or first week November..!

just an update... I called USCIS last 11/07 about my case asking them that my case is already outside of the normal processing time of 4 mos for NSC. The IO said that they are back logged now and they are just processing applications filed on June 17, 2014 that day.... If they process consecutive filing dates everyday, looks like they will touch my case on Dec 3... will update you guys again soon.

Thanks for the update. I've read the same response from the forum but on the other hand, someone was told that NSC processing should picked up this month.. Regardless, hopefully they'll get to July soon, then August.. :) With this trend I'm now expecting my case to be adjudicated by January.. They are processing 485's in 5-6 months max, if everything is good, that is...

any update on your case? i called USCIS earlier this week, and I was told they(NSC) is processing cases received on or before July 16.. I'm just curious if you got any update on yours since your RD is July 1st...

No update yet bro. So they are processing July 16 now? I was planning to call / raise an SR on Dec 12 (30 days after my first SR) but I will call them on Monday instead then. Thanks for the info. Incubus was approved in 159 days. It'll be my 159th day tomorrow. Hope I get a notice too. Saw in some forum that some people gets approval on Saturdays too hehe!

So I was waiting until Jan 12 (60 days after my 1st SR) to call USCIS but decided to call today and check my case status. Tier 1 informed me same info as what on the website so I asked to be transferred to a Tier 2. The hold was for 98 mins so I have them call me back. When they called back, the Tier 2 Officer asked me the usual question. I asked him what's holding my case as it is already almost 6 months and the NSC processing time says 4 months. He put me on hold and he said he will check. When he came back on the phone, he said that my case isn't assigned to any IO so he will make a request to assign it to one. I asked how long will this process be and he said 2 weeks. I didn't make a fuss about it and thank him and hang up.

What the heck is going on at USCIS??? If you don't call and follow up they'll just leave your case pending and won't assign it to an IO??? This wait is really frustrating. You should call and check your cases guys!

The toll number is +1-800-375-5283. After talking to Tier 1, asked to be transferred to Tier 2.

hi bud.. any update on your case? my case will be pending for six months in two weeks.. I've seen and heard from my friends that their cases were approved in average of 170 plus days..

hey bud! still nothing yet. As for the inquiry I did last Jan 6, my case showed that they sent a reply last Jan 15. I didn't received an email reply so I called again and inquired about it. They said that it might be a standard mail reply, not an email. He said to call them back after 15 days if I don't receive anything.

Since my 1st SR was already more than 60 days, I submitted another SR last Fri that my case is outside normal processing time. Got an email confirmation to expect a reply by Feb 7. I'll keep you posted.

Oh ok.. I haven't seen any approvals lately from NSC especially in our category and country of chargeability.. Hope we see some approvals this week. my case will be pending for six months next week.. Im thinking of going through the congress route but I'll wait til next week..

I compared my receipt number with his and if it goes by series, my case was received earlier than his. The way USCIS process cases is really hard to understand.

I was thinking of doing another SR but I'll wait til next week when my case get to the 180th day or six months since they received it. it seems to be slow for us EB3s while they are already approving cases for EB2 with RD in last week of July..

It's the SR that I submitted last week, 1/16. I'm not sure but I think you can only submit another SR after 60 days of the first. If it's after 60 days already, you can submit another one.... That's one big question on how USCIS process cases for approval. You can't get an answer from them. We all we can do is speculate, wait and hope for the best :)

Nothing yet. I was on the phone with an L2 IO this morning and he may have been in a bad mood. He said that they have replied to my SR and have to wait 60 days before inquiring again. I told him that my call was about the letter I received from an earlier inquiry that my case was pre adjudicated but is pending review by an officer awaiting the approval of I140. I told him that my I140 was already approved way back 2009. Then he said that you have to wait for a visa to be available to you as there are thousand of people ahead of you. I don't know if this is true but he also said that everytime we inquire about the case it is pulled out of que and gets delayed??? Since I wont get anything from him, I just thank him and ended the call.

Your friend is very lucky. Is he an EB3 too? It's still a mystery how they process case. Nothing to do but wait and wait and wait :)

That is just very frustrating. They don't know what they're doing. How can a visa. It available to you? My friend's priority date is 2009 and you are 2008!?!?

I know, it is really very frustrating. It's so hard to understand how they process the cases. Did your friend made any inquiry about his case at all or he just waited? Maybe its true that a case is pulled out of que if an inquiry is done???

I will be waiting for 7 mos come February

I dunno if he did an SR but I've read the same thing here in the forum that everytime an inquiry is made it'll cause a delay.. I dunno how true is this but I guess we just have to wait.. My case is pending for 6 months already..

My coworker who filed her AOS last September got her approval already. I'm happy for her but it's really frustrating and disappointing that we, who have submitted earlier haven't, receive an approval yet.

Yes, NSC as well. Received the Welcome letter last Jan 28 and today the status says card is mailed. Deep Sigh! Really frustrating bro!

I know, especially for you. You're way passed the 200th day.. I don't really understand why they won't resolve the pending cases first before going further with the later received cases.. Did you raise another service request? Or try congressional inquiry route?

Yes, the last SR I sent was Jan 16 and received the reply Jan 22 - "Your case is currently under review by an officer. You should receive a decision, correspondence or notice of other action within 60 days of the date of this letter". I need to wait until March 22 to do another inquiry. I'm thinking of doing an Infopass but not sure if it would be of any help at all.

I dunno about infopass, it's a hit or miss depending on the Field office and the person in charge, but I've heard they can give you more insight of your case( assigned to an officer, pending security checks and what not), but I've also read that some just give you the same status as what it is online.. But at this stage I'd say any ways you can try to check and or follow up your case is worth trying..

Dude that's a good sign. Someone is looking at your file. Just reply the RFE and after a week you should get approval.. :) maybe it's just birth certificate.

I know but i have two friends who got RFE for birth certificate when they were sure it was in the packet when they filed. Are you a nurse? if you're in the medical field, might be visa screen certificate.. It could be a lot if things, who knows it might just be a simple stupid pay stubs.. :)

Yea it's totally random like a lottery. But from the past few days, the inventory for EB3s started to go down unlike last few weeks where it barely moves. Which is a good sign for us EB3s. I just hope its continues to progress

Update on my RFE ( for those still watching my case hehe ). They were asking a lot: updated employment letter (since application is pending for 6 mos), most current pay stub, clearer birth certificate and secondary evidence for it (like baptismal cert, hospital or school records showing both my name and my parents) and copy of my old passport that has the visa. Preparing all these documents now. Will keep you posted. Hopefully my next update here is my approval. ;)

Hope you guys still follow this site after getting your GC lol.. anyhow.. it was nice reading all you comments and very informative.. I my self are very anxious for any results that will come my way.. I filed mine in Aug 2014 (eb3 priority date May 2009).. so far its been 7 months already and haven't heard anything yet.. though one of my friend whom it happened that i filed mine 2 weeks in advance that hers got her GC already.. and when i looked on trackit.. found some guys from phils who's in eb3 got theirs too even though they filed their i-485 4 months after us... i can just laugh on what going on with uscis..rommelpc was correct at first... uscis is very mysterious.. i couldnt imagine how they're doing their job.. anyway.. congrats for everyone who receives.."freedom" =)

@ PapaP29 - have you filed a Service Request or called them to find out what is happening on your case? I was following a case that was filed same day as mine, jul 3 and its status is still fingerprint fee received until now. It's 8 mos going to 9 mos pending now. Hopefully you'll get your approval soon.

Nope i haven't, my lawyer just gave me those options to ask yesterday after i told them why some people getting their GC in advance even we filed it first. Anyway i checked the sevice center processing time and i know mine was sent to Texas and based on their records they're processing the one submitted July 24, 2014.. weird because my friend whom filed hers 2 weeks later than mine on the same service center got her GC already.. and i think Nebraska or vermont were processing the ones file in Sept 2014 already.. geez.. good luck to everyone how lucky are those who just filed 2 years ago and got their priority date current already lol.. i believed u waited 12 yrs total.. it'll be my 7th yr in the US.

What is you case status now and what is the last update date? Do you have an account with USCIS.gov so you can check your case status. You can call them in the morning and tell them your case is already pending 7 mos and that you want to talk to a Level 2 Immigration officer. The wait is usually about 2 hrs but it will prompt you if you want them to call you back and take that option. If you dont want to call, raise an SR online. Good luck! update: for some reason i did check current processing dates of texas srvc cntr for i-485, and they have updated it from July 26, 2014 to Aug 28, 2014.. they have recvd our finger printing fee on the 18th of Aug.. hopeful for a favorable result soon. =)

PapaP29, my lawyer told me if the date retrogressed while the GC is being processed, then it will take longer to process the GC. And unfortunately, current visa bulletin shows PI EB3 category retrogressed to July 2007. I just hope she's wrong so you'd get your GC soon.

Please confirm with your atty as well. best of luck.

hi peekeesh.. thanks for the update.. thats kinda heartbreaking to hear.. though who really knows right? =) i also consulted my lawyer today and will wait for her answer. I'm still kinda hopeful because the Texas processing time for I485 employment is still in Aug 25, 2014.. which technically will cover my submission date.

Still patiently waiting. by God's God.
