Hi vyb5b, Congrats on your I 140. Wondering if you are working on H1B or have moved to EAD. And how long does it take to get I-485. I am in a very tricky situation and would like to know how others are managing. Thanx

Hi Coco,

I got EAD card, but not using it. I am still on h1 as I am working with the sponsoring employer itself. Further, I have h1 for another 2 years, so am not in a rush. About time, I am not sure either. My eb1 got approved last week. So am not sure if USCIS even picked my case up for processing.

Right now, processing date is feb 2. So nothing we can do. Would rather wait for 2-3 more weeks and then see. In my opinions SRs dont help.

Do you guys really think processing date will move from feb 2? It hasn't moved for many months and now there is even lesser reason to move as NSC has to clean the massive pile-up, if they move the date forward, they will get bombarded by SR's and infopasses, seems counter-intuitive

Thanks vyb5b. I also think SR is of no use. Someone requested the REF's, right? Have to process those in next few weeks.


batsy71 I don't how often they move the processing date. If you find it plz update.

As long as it stays behind our RDs we will get response saying our case is within standard processing time. So no point taking about SR before processing date moves past our dates.

Did you check the tracker for NSC, EB1B for received date for Feb2016? Jan and March are processed.. All Feb is pending. Hopefully new processing time update would help us.

In this link: https://www.dhs.gov/xlibrary/assets/privacy/privacy_pia_uscis_ibbcs.pdf on page 5 there is mention of Marriage Fraud Assurance System (MFAS).

There is one more case exactly like you on trackitt that I am following (but can't trace back for now). Country of chargeability was China, but nationality was India (EB1B). That applicant's case got transferred to NBC for marriage interview. It seems like they do this for most cross-country marriages, so that might be the case fr you and it might just be in the pipeline to be transferred to NBC. I hope I am wrong though and your family gets approved asap. all the best!

Dont know, raised SR last week, so hoping to hear something about the status. Its been 120 days since RFE response, so not sure whats going on.

That person is EB2, not EB1, so makes sense using china as country of chargeability. I didn't use wife's country of chargeability, so that issue should not come. But lets see what happens. Am ok with interview too, at least then we will know something. Now its just a limbo we are stuck in.

yea. i got that part wrong. all we can do is make educated guesses. The SR response should throw some light hopefully. Do you plan to do infopass?

4th possibility of your SR response is that, it is stuck in queue to be transferred to NBC for interview (which would also explain why they did not mention any of the other 3 typical SR responses). You could find out what is the current processing date in your local USCIS office. might give an idea if the waiting queue is long or short. hope i am wrong though.

spoke to lawyer, he said its generic response, doesnt mean anything. Said he will contact them and check.

Both me and my dependent received vaccination RFE in dec. The response to rfe was received to uscis on Feb 3rd 2017 and mine was approved on Feb 10th but my dependent is still pending. After going thru the forum, many are stuck on BC. Do they send rfe before BC?
